INSURANCE & REINSURANCE LITIGATION

The Firm has extensive experience in court and out-of-court representation of the insurance sector and some reinsurers in contractual and non-contractual cases arising from property, life, civil liability, financial liability, D&O, transportation liability, performance bonds and pension-related insurance policies. This area is encompassed by a team of specialized lawyers.

ADMINISTRATIVE LITIGATION

The Firm attends litigation from administrative contracts, processes of nullity of administrative measures and restitution of rights, direct relief processes and tax liability. We represent our clients in proceedings conducted before the contentious-administrative jurisdiction related to insurance law and oil-related matters.

Also, the Firm has extensive experience in dealing with class and group actions, both before the contentious-administrative and ordinary courts.

CIVIL LIABILITY AND COMMERCIAL MATTERS LITIGATION

The Firm has extensive experience in court representation of companies from the real and services sector in commercial matters related to contract and non-contractual liability. In particular, we litigate in the areas of telecommunications, hydrocarbons, financial law and commercial contracts such as supply, distribution, commercial agency, among others. In the development of this area we have wide experience in different types of ordinary, verbal, declaration of ownership and contentious-administrative litigation. We have also represented our clients in cassation before the Supreme Court of Justice.

AIR & SEA TRANSPORT LITIGATION

The Firm provides legal counseling on concepts and claims regarding carriage of goods and passengers, general damages, collisions, maritime damages and accidents, salvage, maritime agency, ship and aircraft mortgages, pollution and the corresponding procedures before maritime and aeronautical authorities. This activity is performed in close coordination with the litigation and insurance areas, due to the close and critical relationship with them.

ARBITRATION

The Firm has extensive experience in attending cases before arbitration tribunals in Colombia, Singapore, Shanghai and London, on behalf of domestic and foreign companies. We have participated in arbitrations mostly concerning insurance and reinsurance matters and other business issues in the areas of telecommunications and hydrocarbons, among others.

In addition, partners Ricardo Vélez Ochoa and Armando Gutiérrez Villalba have participated in several opportunities as arbitrators in national and international arbitration courts.

INSURANCE AND REINSURANCE LEGAL ADVICE

The Firm provides advisory services concerning objections, insurance policy analysis, insurance program evaluation, and generally everything related to the insurance and reinsurance business.

LABOR & SOCIAL SECURITY LITIGATION

The Firm has a long background and expertise on the handling of litigation and consulting on social security matters related with Insurance Law including, but not limited to, incidents covered by the General Occupational Risk System, the General Pension Fund and the corresponding coverage provided on these events by the pension insurance set forth by Law 100 of 1993. We also conduct recovery actions in favor of Occupational Risk Managing Companies and labor proceedings in which insurance companies are involved.
